Terms and Conditions – Prodigy Woodwork
Last updated: October 12, 2026
1. Acceptance of Terms
By requesting a quote, approving specifications, paying a deposit, or otherwise engaging Prodigy Woodwork ("we," "us," or "our"), you ("Client") agree to be bound by these Terms and Conditions. These terms govern all custom woodworking, furniture production, and related products and services.
2. Quotes, Orders, and Formation of Contract
Quotes are valid for a period of 90 days. A binding contract is formed once we receive the required deposit along with written approval (via email or signature) of the final specifications, drawings, materials, and finishes. Website content, photographs, and inquiries are invitations to treat and do not constitute binding offers. The Client is responsible for the accuracy of all measurements, site conditions, and design information provided. We are not liable for errors resulting from incorrect information supplied by the Client unless we performed the site measurements.
3. Specifications, Approvals, and Change Orders
Production proceeds solely based on the approved specifications. Any modifications requested after approval—including changes to design, dimensions, materials, hardware, or finish—require a written change order. Such changes may increase the project price and extend the production timeline. All additional costs must be paid before work on the requested change commences.
4. Pricing and Payment
• A non-refundable deposit of 50% is required to schedule the project, procure materials, and reserve shop time.
• The remaining 50% balance is due prior to delivery, pickup, or installation.
• Larger projects may utilize a mutually agreed-upon milestone payment schedule.
• Accepted payment methods include cash, credit cards, PayPal, Zelle, and Venmo.
• Invoices that remain unpaid after the due date may incur a late fee of 1.5% per month, or the maximum rate permitted by law. We reserve the right to suspend work for non-payment.
The initial deposit covers material procurement, design development, and opportunity costs. Once materials have been ordered or fabrication has begun, the deposit becomes entirely non-refundable.
5. Cancellations and Refunds
You may cancel the project in writing within five business days of paying the deposit, provided that materials have not been ordered and production has not commenced. In such instances, we will refund the deposit minus any design, consultation, or administrative fees already incurred. After materials are ordered or production starts, the deposit is non-refundable, and you remain responsible for the cost of all materials purchased and labor completed. Custom-made items are not eligible for return or exchange.
6. Timelines
Lead times provided are estimates only. These timelines begin only after the receipt of the deposit and the final approval of all specifications. Delays caused by material availability, Client response times, site readiness, or events beyond our reasonable control do not entitle the Client to damages or a refund.
7. Delivery, Pickup, Installation, and Risk
• Title and the risk of loss pass to the Client upon delivery to the agreed location or upon pickup.
• You must ensure reasonable access and confirm that the site is ready for delivery. Additional charges may apply for difficult access.
• Installation services, if offered, are quoted separately and remain subject to site conditions.
• If you are unable to accept delivery or arrange for pickup within 14 days of being notified that the work is complete, we may charge reasonable storage fees.
• The Client must inspect all items promptly and report any obvious damage or defects in writing within seven days of receipt.
8. Natural Characteristics of Wood
Wood is a natural material. Variations in grain, color, texture, knots, and mineral streaks, as well as minor movements such as expansion or contraction due to changes in humidity and temperature, are inherent and expected. These characteristics are not considered defects. Photos and finish samples are representative only. We recommend maintaining an indoor relative humidity level between approximately 30% and 50% to minimize wood movement.
9. Limited One-Year Warranty
We warrant our workmanship against structural defects under normal indoor residential use for one (1) year from the date of delivery or pickup. The remedy is limited to the repair or replacement, at our discretion, of failures caused by defective workmanship. This warranty does not cover:
• Normal wear and tear or finish degradation in high-traffic areas.
• Damage resulting from misuse, abuse, accidents, or improper care.
• Natural wood movement, checking, or color changes occurring over time.
• Damage caused by extreme humidity, temperature fluctuations, direct sunlight, or improper installation performed by others.
• Client-supplied materials or designs.
Claims must be submitted in writing and accompanied by photographs. This constitutes the sole warranty provided. All implied warranties are disclaimed to the fullest extent permitted by law.
10. Intellectual Property
All original designs, drawings, CAD files, and photographs remain our exclusive intellectual property. You are granted a license to use the finished physical product. We reserves the right to use photographs of completed work for portfolio and marketing purposes, though identifying details will be removed upon request.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability is limited to the amount paid for the specific project. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability for death or personal injury caused by negligence where such limitation is prohibited by law.
12. Governing Law
These terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes arising from this agreement shall be resolved in the courts of Allegheny County, Pennsylvania.
